  • Dispute resolution concerning all aspects of Aboriginal law for business, First Nations, other governments including municipalities, and individuals.
  • Representation before federal and provincial trial and appellate courts and tribunals on Aboriginal law matters, including injunction applications and interventions.
  • Assessment, filing, negotiation and settlement of Comprehensive Claims, Specific Claims, Special Claims and self-government claims.

  • Advice and dispute resolution on all aspects of taxation and customs law affecting Aboriginal peoples, businesses and individuals under the Income Tax Act, Excise Tax Act, Excise Act, Customs Act and provincial legislation, including dealing with the Canada Revenue Agency and Canada Border Services Agency, filing objections and appeals, responding to audits and information requirements, search and seizure, and providing representation before the Tax Court, Canadian International Trade Tribunal and Federal Court.
  • Development of restorative and transformative justice initiatives connected to the defence or prosecution of regulatory and criminal offences.
  • Advice on environmental management and protection, natural resource management, energy (including wind, solar, hydro-electric, transmission and other means of production), forestry, fisheries, agriculture and aquaculture development

 

GORDON SCOTT CAMPBELL’S ABORIGINAL LAW EXPERIENCE

  • Litigated Aboriginal law matters up to level of Supreme Court of Canada.
  • Led numerous multilateral negotiations in Ontario, British Columbia, Manitoba and Nova Scotia to resolve high value claims concerning Aboriginal rights, Aboriginal land title and Aboriginal historic treaties under the Comprehensive Claims Policy as well as the Specific Claims Policy. Also involved with Special and other claims falling outside of existing processes and policies.
  • Collaborated with experts in forestry, fisheries, agriculture, mining, flooding, wildlife, engineering, land appraisal and statistics in developing practical, legally sound and widely acceptable methodologies for addressing past losses and future uses of land and resources over which Aboriginal peoples have an interest.
  • Drafted settlement agreements, implementation plans and ratification vote procedures which resolved longstanding Aboriginal-Crown disputes.
  • Developed and managed multi-stakeholder consultation and communication programs involving federal, provincial and municipal governments, First Nations, industry, private land owners and interest groups.
  • Advanced additions to reserves and the creation of new reserves.
  • Advised on establishing legislation and procedural rules for the new Specific Claims Tribunal.
  • Facilitated dialogue on environmental assessments and licencing reviews concerning pipeline, mining, forestry, fishing, oil and gas, and industrial development in locations of concern to Aboriginal peoples
